A. We are Kava Images Content s.r.o. (Company ID: 24145467), U dálnice 815/6, Stodůlky, Praha 5, PSČ 155 00, Czech Republic, EU (“RFclipart”). This policy establishes how we handle your personal information if you are an RFclipart user or visitor to our Sites. It applies to VectorGuru website as well as the main RFclipart website (collectively named as the “Sites” in the following document).

B. For the purposes of clarity in this document ‘we’, ‘us’ or ‘RFclipart’ is the same, as we own and run the Sites.

C. The word ‘policy’ here means this privacy policy. The collocation ‘user terms’ means the rules for using each of the respective Sites separately. The rules vary by website and each website makes them separately available and seeks consent to them separately to this policy.

What kind of personal information do we collect?

D. We collect certain personal information about visitors and users of our Sites.

E. Information collected includes: user names, member names, email addresses, IP addresses, your website profile information, images set as profile avatars, survey data, payment information such as payment agent details, transactional details, support queries, content you direct us to make available on our Sites and web analytics data. We also collect personal data from content providers, such as any internationally standardized identification document, collected as a prerequisite for funds withdrawal operations.

How do we collect this personal information?

F. We collect personal information directly when you provide it to us, automatically as you navigate the Sites, or from third parties when you use services associated with the Sites.

G. We collect your personal information when you provide it to us by completing membership registration or buying\providing items or services on our Sites, subscribing to any of our newsletters, email lists; also when you submit feedback, fill out a survey, or send us a support query.

What kind of personal information we collect about you from others?

H. Although we generally collect personal information directly from you, sometimes we also collect other categories of personal information about you from other sources - those are:

H.1 transaction details from payment providers located in the US and UK in order to complete the transaction;

H.2 third party service providers (like Google, Facebook) who are located in the US or UK, which may provide us with the information about you such as your registration and profile from that service, when you link, connect, or login to your account with the third party service. This information may vary and is generally controlled by that service provider or as authorized by you via your privacy settings at that service provider;

H.3 information about you as a rights holder claimant from our content providers (authors).

How do we use personal information?

I. We may use your personal information:

I.1 To fulfill a contract obligation: in particular, in facilitating and processing transactions that take place on the Sites, mostly purchases and withdrawal operations.

I.2 Where it is necessary for purposes which are in our (or third parties’), legitimate interests. These include:

 I.2.1 ensuring the uninterrupted and efficient Sites operation;

 I.2.2 providing you with the services described on the Sites;

 I.2.3 verifying your identity when you login to any of our Sites;

 I.2.4 responding to support queries, and helping facilitate the resolution of any disputes;

 I.2.5 keeping you posted with operational news and information about our Sites and services e.g. to notify you about changes to our Sites, network disruptions or security updates;

 I.2.6 carrying out technical analysis to determine how to improve the Sites and services provided;

 I.2.7 monitoring activity on the Sites, to identify potential copyright infringement activity and to ensure compliance with the user terms that apply to the Sites;

 I.2.8 keeping in touch with you, by responding to your support queries submitted to us on the Sites or asking for your feedback or whether you want to participate in a survey;

 I.2.9 managing our legal and operational affairs;

 I.2.10 improving our products and services.

I.3 Where you give us consent:

 I.3.1 to provide you with marketing information about products and services which may interest you;

 I.3.2 to customize our services and websites, like advertising that appear on the Site (where this involves the use of cookies or similar technologies) in order to provide a more personalized experience.

I.4 For purposes which are required by law.

I.5 For the purposes of responding to requests made by government, a court of law, or law enforcement authorities conducting an investigation.

Where exactly we may disclose your personal information?

J. We shall disclose personal information to the following recipients:

 J.1 projects governed by Kava Images Content s.r.o.;

 J.2 service providers who assist us in the ways we use personal information (as set out above), in particular: website hosting providers which are located in Canada, US and Netherlands; analytics services which are located in the US; subscription management services which are located in Latvia, EU; payment processing services which are located in US and UK; identification verification services located in the US.

 J.3 our professional advisors (lawyers, accountants etc.) which are located in Czech Republic, EU;

 J.4 inspectors and government authorities related to our compliance procedures and obligations;

 J.5 an investor or prospective investor, taking interest to purchase all or part of our assets or our business, and their professional advisors helping to facilitate the purchase itself;

 J.6 government authorities in response to requests related to a criminal investigation or alleged or suspected illegal activity;

 J.7 a third party, in order to enforce or defend our rights, or to address financial or reputational risks;

 J.8 a rights holder in relation to an allegation of intellectual property infringement or any similar case;

 J.9 other recipients where we are required by law to do so.

Where we store and (or transfer to) your personal information?

K. We are based in Czech Republic, EU so your data will be processed in Czech Republic, EU and Canada, Netherlands and US (server locations). Some of the recipients we have described in section J above, and to whom we disclose your personal information may be based partially or completely in other countries; we do this on the basis of your consent to this policy. In order to protect your information, we take care where possible to work with service providers who we believe maintain an acceptable quality standard of data security routine.

How do we keep your personal information secure?

L. We store personal data on our secure servers that are managed by us and our service providers, and occasionally back-up the files that are kept in a secure location in Canada and Netherlands, EU. Personal information that we store or transfer is protected by security and access controls, including username and password authentication, and data encryption where possible.

How you can access your personal information?

M. You can access some of the personal information that we collect about you by signing in to your account. You also maintain the right to make a request to access other personal information we hold about you and to request corrections of any errors in that data. You can also close the account you have with us for any of our Sites at any time. To make an access or correction request, contact our support service using the standard support system on any of our websites.

Marketing choices regarding your personal information

N. Where we have your consent to do so (if you have subscribed to one of our e-mail lists or have indicated that you are interested in receiving offers or information from us), we may send you marketing messages by email about products and services that may be (in our opinion) of interest to you. You can opt-out of such experience if you would prefer not to receive them in the future by using the “unsubscribe” option provided in the message itself, or by changing the mailing settings in your profile.

O. You also have options with cookies available, as described below. By modifying your browser preferences, you have the choose whether to accept all cookies, be notified when a cookie is set, or to reject all cookies. If you choose to reject cookies some parts of our Sites may not work properly for you.

Q. When you visit our Sites, certain information is recorded and kept which is usually anonymous information and does not reveal your identity. If you’re logged in to your account some of this information could be associated with it; we’re talking about the following kinds of details:

Q.2 the domain name requested;

Q.3 the date and time of your visit to the website;

Q.4 the length of your session (Google Analytics only);

Q.5 the number of times you access a particular site of ours within any month;

Q.6 the file URL you download and information related to it;

Q.7 the website which referred you to our Sites;

Q.8 the operating system installed on your computer.

R. Occasionally, we will use third party advertising companies to serve ads based on prior visits to our Sites (Google Adwords Remarketing Service). For example, if you visit our Sites, you may later see an ad for our products and services when you visit a different website.

Information about children

S. Our Sites are not for children under the age of 16 years, so if you are under 16 we ask that you do not use our Sites or give us your personal information. If you are from 16 to 18 years, you can browse the Sites or become a registered user, but you should do this under the supervision of a parent or guardian. In an event that we learn that we have collected personal information from a child under age 16 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under the age of 16, please contact us via our support system.

Regarding information you make public or disclose to others

T. If you disclose your personal information to other people, we can’t control or accept responsibility for the way they will use the data in question. There is more than one way to disclose information, such as a public message on a forum thread, sharing information via social media, or making contact with another user (such as a third party Author) via other websites or directly via email. Think carefully before making your information publicly available or disclosing your information to anyone else. If you are sharing information via another website, check the privacy policy for that site to understand its information management practices as RFclipart privacy policy will not apply.

For how long do we keep your personal information?

U. We store your personal information for as long as it is necessary to comply with our business and legal obligations. If you no longer wish that we use your personal information or to provide you with our services, you can request the erasure of your personal information and close your account. Please note that if you request this, we shall retain information from deleted accounts as necessary for our legitimate business interests, to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the terms of service and take other actions permitted by law. In case of account deletion, any items sold previously shall remain available to their respective buyers for the duration of validity the license agreement. The information we retain after deletion will be handled in accordance with this Privacy Policy.

Will this policy change and receive updates?

V. We may have the need to change this policy from time to time to make sure it stays up to date with the latest legal requirements and any changes to our privacy management methods.

W. When the changes do come, we shall make sure to notify you about such changes, where required. The latest version of this policy will always be available on this page.

1. For the purposes of applicable EU data protection law (including the General Data Protection Regulation 2016/679 (the “GDPR”), we are a ‘data controller’ of your personal information.

2. You are also entitled to ask us to port your personal information (i.e. to transfer in a structured, commonly used and machine-readable format, to you), to erase it, or restrict its processing. You also have rights to object to some processing that is based on our legitimate interests, such as profiling that we perform for the purposes of direct marketing, and, where we have asked for your consent to process your data, to withdraw this consent as more fully described below.

3. These rights are limited in some situations – for example, we can demonstrate that we have a legal requirement to process your personal information. In some instances, this means that we may retain some data even if you withdraw your consent.

4. Where we require your personal information to comply with legal or contractual obligations, then provision of such data is mandatory: if such data is not provided, then we will not be able to manage our contractual relationship with you, or to meet obligations placed on us. In all other cases, provision of requested personal information is optional.

5. If you have unresolved concerns you also have the right to complain to data protection authorities. The relevant data protection authority will be the data protection authority of the country: (i) of your habitual residence; (ii) of your place of work; or (iii) in which you consider the alleged infringement has occurred.
